Terms of Ticket Booking Services

Reminder

Welcome to Damai (domain name: damai.cn), a website operated by  Beijing Damai Cultural Media Development Co., Ltd.   and its affiliates (hereinafter referred to as “Damai”). Damai will provide you with  events booking services (including online or live performances, competitions and exhibitions etc.) as well as other booking services for derivative merchandise, discount coupons, member cards and etc.  

Before enjoying various services offered by Damai, please read carefully the Terms of Ticket Booking Services (hereinafter referred to as “Booking Terms” or “Terms").  The way of any confirmation, acceptance and/or update to this Terms is the same with Damai Member Service Agreement. Please pay special attention to the underlined part that involve your vital rights and interests.

I. Creation, Effectiveness and Cancellation of Orders

1. Damai shall display the basic information about an event on the event details page, which may vary from event to event but normally contains the name, time and location of the event, precautions, whether a refund on the tickets is supported, and other key information, to enable you to have a full knowledge about the event.

2. Before you submit an order, please read carefully all the information on the event details page and make sure that you have fully understood and agreed to such information.

3. Once you have successfully submitted an order on Damai, an order will be created; the order will officially take effect upon your completion of payment. You are suggested to, before making the payment, reconfirm whether the ordered merchandise or service meets your expectation; if not, you may abort the payment. If you fail in making the payment within the specified time (usually within 15 minutes) after having successfully submitted the order, the system will automatically cancel the order, and neither you nor Damai shall be liable to each other.

4. In order to protect the vital interests of Damai members, Damai has the right to cancel the orders that have already been created or come into effect upon discovering any abnormal ordering, which include but are not limited to: (1) placing extra orders (beyond the purchasing limit) using the same ID; (2) the placing, by reasonable judgment, is believed to be made by non-real consumers, including but not limited to, placing extra orders using the same or a fictitious payment account number, delivery address (either the address given at the time of order placing or the actual delivery address), recipient or phone number.

5. Article I and Article VI shall applicable to non-ticket merchandise or services, such as derivative merchandise, discount coupons and member cards. Any specific content, information and/or relevant rules concerning such non-ticket merchandise or services shall be specified on the sales page.

 

II. Ticket distribution and miscellaneous

1. Ticket type: Tickets generally come in two types: paper tickets and e-tickets. Different events have different tickets, and the ticket information on the event details page shall prevail.

1.1 If you have booked a paper ticket, you may choose to have it sent by an express delivery or self-collection. If you choose the express delivery, it means that you have agreed to allow us to arrange a third-party express company (such as EMS and SF Express) to deliver your ticket. Please check carefully your ticket against your order before signing for the receipt thereof. If there is any discrepancy, you may refuse to sign, and contact Damai customer service for confirmation at the earliest possible time. In the case of self-collection, you shall check the ticket on the spot, and raise your doubts if there is any discrepancy with the order. If you do not raise any objection on the spot after you have collected the ticket or sign for the receipt thereof, you shall be deemed to have agreed that the ticket is consistent with the order.

1.2 If you have booked an e-ticket, you need to prepare in advance corresponding admission credentials required for this e-ticket and the device used to store and display the e-ticket, and shall ensure the software and hardware environment supports the proper operation of the device. For example, for ordinary e-tickets that were not registered with an ID card, the QR code will be used as the admission credential; For e-tickets that were registered with an ID card, the ID card will be used as the admission credential; If any e-ticket needs to be converted into a paper ticket, you need to complete the conversion within the time range at the place and using the method as notified to you through the event details page, e-ticket folder or SMS notification. You may also directly consult our customer service.

The online event, for which you have purchased a ticket, will be broadcasted by a third-party service provider. The rules governing the ticket use, transfer and refund will be displayed on the event details page.

2. The tickets are generally bearer tickets, except for those purchased with real name as clearly stated on the event details page. Tickets cannot be replaced after you have signed for the receipt of them or collected them. People without tickets are not admitted to the venue of the event. Please keep the tickets in a safe place to prevent loss.

3. The invoices for tickets will be issued by the host of the event. For details, please refer to the "Basic Information" on the event details page.

 

III. Delay or Cancellation of Events

The event may be cancelled or postponed due to various unforeseen factors. You fully understand and agree that:

1. If the event is cancelled due to force majeure, Damai has the right to cancel the order and refund the amount you actually paid for the ticket after receiving the same from the host (the amount does not include the express fee you paid when you purchased the ticket). If the event is postponed and is so confirmed by the host, you may choose to: (1) continue to use the ticket in the postponed performance; or (2) ask for a refund for the ticket according to the provisions of this clause. If you fail to handle the refund within the specified time range upon notification, you will be automatically deemed to have agreed to change the ticket to a new one for the postponed performance.

2. If the event is cancelled due to any reason attributable to the host, Damai has the right to cancel the order and refund the full amount you have paid actually to you after receiving the same from the host (the amount includes the express fee you paid when you purchased the ticket). If the event is postponed and is so confirmed by the host, you may choose to: (1) continue to use the ticket in the postponed performance; or (2) ask for a refund for the ticket according to the provisions of this clause. If you fail to handle the refund within the specified time range, you will be automatically deemed to have agreed to change the ticket to a new one for the postponed performance.

3. In case of any cancellation or postponement of any event, regardless of the reason, Damai will handle the aforementioned ticket refund and change for you in the way as specified by the host of the event. You agree that Damai is neither liable to you for breach of contract or for compensation as a result thereof.

 

IV. Ticket refund and change caused by users

1. 7-day unconditional refund not supported- applicable to events “not supporting ticket refund” as marked on the event sales page.

As the performance/event tickets are not ordinary commodities, the cultural services behind them are time-sensitive and scarce and the returned tickets are hard to be re-sold. You understand and agree that the “7-day unconditional refund policy” is not applicable to the ticket booking services provided by Damai, except under circumstances described in paragraph 2, Article IV hereof. With respect to any event under the list “not supporting ticket refund” as marked on the event sales page, if you cannot use the ticket therefor, you will have to dispose of it by yourself.

2. Exceptions

According to the refund policies of the host, some events support the refund application initiated by users under the following conditions (please refer to the the details page for any additions):

1.1 "Worry-free refund”- applicable to events so marked on the event sales page.

For such events, you may only get a refund provided that none of tickets you have purchased in the same order is used. If more than one ticket is purchased in the same order, and if none of the tickets is used, you may get a refund for all the tickets. If any ticket in the same order has been used by you, you may not get a refund for the remaining tickets.

You may at any time make a refund application online for the ticket you have paid but have not used, no matter whether the event is over or not. Upon completion of the refund process, the amount you have actually paid for the ticket will be refunded to your account within 7 business days following the original payment path.

To reschedule your ticket, you need to apply for a refund for all tickets in the same order first, and then re-book your ticket.

1.2 Conditional refund- applicable to events so marked on the event sales page.

Damai will refund to you the costs of the ticket you have actually paid (excluding the express fee), less the processing fee which is calculated based on the length of period between the refund application date (as defined below) and the event commence date. However, as impacted by the sales period of the tickets, the ticket shall not be refunded to you within 3 days prior to the event commence date.

"Refund application date": (1) For paper ticket refund applications, if the paper ticket has not been delivered by the time when you notify us of your intention for a refund, then the day when you call the customer service to apply for the refund is deemed as the refund application date. Damai will refund the amount to your account following the original payment path within 7 business days (postponed accordingly in case of public holidays) from the date of accepting your refund application; If, by the time you notify us of your intention for a refund, the paper ticket has been in the delivery process, you shall, upon receiving the paper ticket, return it as soon as possible to the address designated by Damai following the instructions of the customer service. The date when Damai receives the returned paper ticket (the date stated in the express delivery receipt) is deemed as the refund application date. Damai will refund the amount  within 7 business days (postponed accordingly in case of public holidays) from the date of receipt of your returned ticket (the date stated in the express delivery receipt) to your account following the original payment path. (2) For e-ticket refund applications, the date when you formally notify us of your intention for a refund is deemed as the refund application date. If your e-ticket has been converted into a paper ticket, the refund shall be made in accordance with the refund procedures for paper tickets. Upon completion of the refund process, the relevant amount for your ticket  will be refunded to your account within 7 business days following the original payment path.

1. Refund shall not be available to any abnormal orders.

 Refund processing fees may vary from event to event according to the requirements of the event host. In case there’s any discrepancy between the above standard and the refund rules displayed on the event details page when you place an order, the refund rules on the event details page shall prevail.

3. Ticket change service within 2 hours - applicable to events having a tag of “changeable within limited time “as displayed on the event sales page.

If you find, upon completing the payment, the ticket you booked is not what you have expected and you want to change it, you may contact Damai customer service to change the ticket for you within 2 hours of successful payment; Any ticket change application beyond the aforementioned time range will not be accepted, and you shall be solely liable for the loss caused thereby. The "ticket change" as mentioned herein refers to change of ticket for the same event, and can only take place when there are tickets you have expected in stock. The ticket change shall only be performed under the instructions of Damai customer service; please do not operate alone. Please note that the aforementioned ticket change application must be made 3 days before the event commences.

 

V. E-ticket transfer

1. If the e-ticket you have purchased supports transfer, you may transfer it to any other registered users of Damai through the ticket folder function within Damai. The e-ticket transfer function for each event will be closed 24 hours before the event commences. If you want to transfer your e-ticket, please complete it before the deadline (for special events, please refer to the agreement on the event details page).

2. The transfer shall be deemed completed after the ticket purchaser or holder initiates a transfer and the recipient confirms the receipt of the ticket through Damai ticket folder. The ticket purchaser or holder may still withdraw the ticket before the recipient confirms the receipt thereof.

3. Under all scenarios, the right to return the e-ticket and receive a refund only belongs to the original purchaser who has placed an order for the ticket on Damai. To apply for a refund for the ticket that has been successfully transferred for whatever reason, the ticket holder needs to transfer the ticket back to the account of the original holder at Damai through the original path, and the original holder shall handle the refund procedures in accordance with the set procedures by virtue of the ticket and the order.

4. A ticket holder may only launch transfer of an e-ticket once. Once the e-ticket is converted by the ticket holder to a paper ticket, its subsequent use shall be subject to the rules governing the paper tickets, including but not limited to, the unavailability of the transfer function, and the requirements for sending back of the ticket for a refund.

5. To use the transfer function described in this clause, you shall ensure that the transfer does not involve any paid transactions; otherwise you shall be held liable for all possible losses caused to Damai or the related right holders.

 

VI. Pre-sale events

1. If any event has a tag of “presale” “presale-stage” “reservation” or something similar on the event details page, it means that the quantity of the tickets and seats for the event have not yet been finalized, and this is only providing you with a channel to purchase the ticket. The tickets will be officially sold after both the event host event and the stadium have determined the final quantity of tickets and seats for the event. There is a possibility that you may not be able to obtain the reserved ticket due to insufficiency of the tickets.

2. As long as you have paid the earnest money for the ticket in the pre-sale stage, you will be deemed to have agreed to the reservation rules as described in this clause and that you will not apply for a refund for the ticket you have actually received for non-ideal seat or field. The refund rules for pre-sale events are the same as those for other events. Please refer to the ticket refund information on the pre-sale page.

3. If you cannot obtain the reserved ticket due to insufficiency of tickets, Damai will notify you at the earliest possible time, cancel your reservation, and refund the earnest money you have paid to you. You agree that Damai/or the host of the event is neither liable to you for breach of contract or for compensation as a result thereof.

 

VII. Miscellaneous

The Terms are supplementary to, and have the same legal effect as, Damai Member Service Agreement. Matters uncovered herein are governed by relevant provisions of Damai Member Service Agreement.
